Please read these Terms of Service carefully before using Portio. By downloading or using the app, you agree to be bound by these terms. If you do not agree, do not use the app.
1. Acceptance of Terms
These Terms of Service ("Terms") form a legal agreement between you and Arkio Labs ("we", "us", "our") governing your use of the Portio mobile application ("the App") and any related services. By accessing or using the App, you confirm that you are at least 13 years old (or 16 in the EU/UK) and that you agree to these Terms.
2. Use of the App
Portio grants you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes, subject to these Terms.
You agree not to:
- Copy, modify, distribute, sell, or lease any part of the App
- Reverse engineer, decompile, or attempt to extract the source code of the App
- Use the App for any unlawful purpose or in violation of any applicable laws
- Interfere with or disrupt the integrity or performance of the App or its related systems
- Attempt to gain unauthorised access to any part of the App or its infrastructure
3. Accounts
Portio currently does not require an account to use the core features of the App. Your data is stored locally on your device. If account features are introduced in the future, you will be responsible for maintaining the confidentiality of your credentials and for all activity under your account.
4. Subscriptions and Billing
Portio offers an optional paid subscription ("Portio Pro") that unlocks additional features. The following terms apply to subscriptions:
- Billing: Subscriptions are billed through the Apple App Store or Google Play. Your payment method on file with Apple or Google will be charged at the start of each billing period.
- Auto-renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
- Free trials: If a free trial is offered, you will not be charged until the trial period ends. Cancel before the trial ends to avoid charges.
- Cancellation: You may cancel your subscription at any time via your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time.
- Price changes: We may change subscription prices. You will be notified in advance of any price change. Continued use after the change constitutes acceptance.
- Refunds: Refund requests are handled by Apple or Google according to their respective policies. We do not process refunds directly.
5. Intellectual Property
The App, including its design, code, graphics, icons, and content, is owned by Arkio Labs and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any intellectual property rights to you.
You retain ownership of any content you create within the App (your shot logs, notes, bean entries). You grant us a limited licence to store and display this content on your device for the purpose of providing the App's functionality. We do not claim ownership of your brewing data.
6. User Content and Conduct
You are solely responsible for the data and content you enter into the App. You represent that your use of the App will comply with all applicable laws and regulations.
7. Third-Party Services
The App integrates with or relies on third-party services including Apple, Google, and Bluetooth hardware manufacturers. These services are governed by their own terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.
8. Disclaimers and Limitation of Liability
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee that any data stored in the App will not be lost.
To the maximum extent permitted by applicable law, Arkio Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the App — including loss of data, loss of profits, or any other loss — even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or relating to these Terms or the App shall not exceed the amount you paid us in the twelve months preceding the claim.
9. Indemnification
You agree to indemnify, defend, and hold harmless Arkio Labs and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of your use of the App, your violation of these Terms, or your violation of any rights of a third party.
10. Termination
We reserve the right to suspend or terminate your access to the App at our discretion, with or without notice, if we believe you have violated these Terms or if required by law. Upon termination, the licence granted to you ends immediately. All provisions that by their nature should survive termination will do so, including ownership, warranty disclaimers, and limitations of liability.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Arkio Labs is registered, without regard to conflict of law principles. Any disputes arising from these Terms or the App shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
12. Changes to These Terms
We may revise these Terms at any time by updating this page. The "Last updated" date will reflect the most recent revision. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the App.
13. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
